A new legislative measure may serve as the solution to finally oust a leftist judge who attempted to obstruct President Trump’s initiative to deport illegal immigrants to El Salvador, prompting Congress to seek alternatives to impeachment for permanently removing the judge.
In this context, a resolution put forth by Rep. Andy Biggs (R-AZ) aims to circumvent the formal impeachment procedure concerning Judge James Boasberg, who has faced criticism after allegedly issuing a temporary order that halted the deportation of illegal immigrants to El Salvador. This resolution, introduced on March 31, 2025, seeks to remove Judge Boasberg from his position for failing to adhere to the “Good Behavior” Clause of the United States Constitution.
As stated in a press release from Rep. Biggs, the resolution references Article III, Section 1 of the Constitution — commonly referred to as the “Good Behavior” Clause — which empowers Congress to create all federal courts subordinate to the U.S. Supreme Court, and stipulates that judges may retain their positions only during periods of good behavior.
Furthermore, the press release clarified that Judge Boasberg arguably breached the Constitution by “knowingly and unjustly interfering with President Trump’s execution of foreign policy and targeting President Trump for partisan purposes and political gain.” The release further asserted, “Under the Good Behavior Clause, Boasberg’s actions amount to misbehavior and render him subject to removal from office.”
In discussing the necessity of Judge Boasberg’s removal, Congressman Biggs remarked, “We cannot remain passive while activist judges, who mistakenly believe they possess greater authority than the duly-elected President of the United States, impose their own political agendas on the American populace.”
Continuing, Representative Biggs contended that impeachment, which has already been the focus of multiple resolutions, would not be sufficiently effective to remove Boasberg. He elaborated, “I have cosponsored resolutions aimed at impeaching Judge Boasberg. However, his removal from office through impeachment will certainly be obstructed by Democrats in the Senate, as it necessitates a two-thirds majority.” Representative Biggs further stated, “Conversely, my resolution claims, in accordance with Article III, Section 1, that rogue judges may be removed in the same manner as we confirm them — by a simple majority.”]
Concluding his remarks, Representative Biggs argued that Judge Boasberg “has misused his judicial authority for political advantage,” adding that he “is not adhering to the Constitutional Good Behavior Clause.” With a palpable sense of urgency, Representative Biggs insisted, “He must not be allowed to retain his position. Congress has an obligation to uphold the commitments we’ve made to the American people, which includes defending the President’s authority to enforce our laws.”
In the resolution, Representative Biggs also asserted that Judge Boasberg has “deliberately overstepped the limits of his office’s power,” adding that the judge “unfairly interfered in the execution of foreign policy for the partisan purpose of obstructing the implementation of the President’s foreign policy and for political gain.” Representative Biggs concluded that Boasberg “should be removed from office and should no longer be recognized as a judge of the United States.”
